HIPAA Privacy: Medicare Conditions of Participation

In 2013, the Centers for Medicare & Medicaid Services (CMS) issued interpretive guidelines for the Medicare Conditions of Participation (CoPs) related to patient privacy and the confidentiality of medical records. Despite the recommendation from various organizations, such as the American Hospital Association, that patient privacy be governed solely by the Health Insurance Portability and Accountability Act (HIPAA), as administered and enforced exclusively by the Office for Civil Rights (OCR), CMS has injected itself into the privacy arena by taking the opportunity to, as they describe, "clarify our guidance for the hospital requirements governing patient privacy and medical records" in the CoPs.
