Taxing the Tax-Exempt? Impact of the Tax Cuts and Jobs Act on Tax-Exempt Organizations

Overview
The Tax Cuts and Jobs Act of 2017 contains many provisions that may impact tax-exempt organizations. We will discuss, in particular, its impact on tax-exempt hospitals, with a specific focus on the following:
- New 21 percent excise tax for covered employee compensation exceeding $1 million per individual (definitions, current law, and IRS guidance)
- Changes to unrelated business income tax:
- The new tax rate
- Reporting requirements regarding unrelated business activities and use of net operating loss carry forwards
- Tax treatment of fringe benefits and potential impact of changes to employer-provided parking
- Opportunities for planning under the new Act
